A scooter crash in Los Angeles or Orange County can leave you sorting through a rental app, driver information and medical appointments at the same time. Whether you were riding a rental scooter or your own, the useful first step is to document what happened without assuming who is responsible or which policy applies.

Call 911 in an emergency and get appropriate medical care. When it is safe, keep the records below. Our California bicycle and scooter accident attorneys can review the available information during a free consultation.

What to save after an electric scooter accident

  • The scooter: photographs of the device, identifying number and visible damage, without altering or testing damaged equipment.
  • The rental record: the trip receipt, start and end times, location shown in the app and any support messages.
  • The scene: photographs of vehicle positions, road conditions, signs and any obstruction, taken only from a safe location.
  • The people involved: driver and witness contacts, vehicle and insurance information, and any police report number.
  • Your follow-up: appointment records, receipts, missed-work information and copies of claim correspondence.

If a rental company collects the scooter, record its identifying information and your support reference when possible. Keep the original photos and messages. Tell your attorney promptly if you believe equipment condition contributed to the crash so appropriate preservation steps can be considered.

Who may be responsible for a scooter crash?

The answer depends on the evidence. A collision may involve another driver’s actions, another rider, a road condition or a problem with the scooter. A business name on an app or vehicle does not automatically establish responsibility.

If a car struck you

Save the driver’s information, any witness contacts and photographs that help explain where each road user was traveling. Questions about turning, lane position, traffic signals and visibility should be assessed against the available evidence.

If you believe the scooter malfunctioned

Describe what you experienced, such as a brake that did not respond, without trying to diagnose the cause yourself. Keep the rental agreement and incident correspondence. Responsibility and the effect of any contract terms require a review of the facts.

If a road condition or public agency may be involved

Save the exact location and photographs if it is safe. Public-entity claims have special procedures and deadlines. The California Courts guide explains that a personal injury claim generally must be presented to the agency within six months, before a lawsuit. Exceptions and separate lawsuit deadlines can matter, so seek advice promptly.

If another scooter rider caused the collision

A potential injury claim is not limited to cases involving a delivery rider or extreme recklessness. Liability, evidence and available insurance are separate questions. The California Courts personal injury guide explains the general role of negligence in injury cases.

Does insurance cover a scooter accident?

Do not assume that every scooter injury is excluded from insurance or that a rental automatically provides coverage. The vehicle involved, the policy language, the insured people and the circumstances of the collision all need to be reviewed. Keep any denial letter and ask which policy provision the insurer is relying on.

The California Department of Insurance’s auto insurance guide explains that policies identify covered losses, exclusions and limits. Our UM/UIM guide provides background on that coverage; it does not establish coverage for an individual scooter collision.

Check the rules for your type of scooter

Motorized stand-up scooters, mopeds, motorcycles and electric bicycles are different vehicle categories. Use the California DMV’s vehicle guidance to identify which rules to check. Device type and local restrictions matter; do not rely on rental availability as proof that riding is permitted everywhere.
